By downloading, installing, or using the Orally app or website, you agree to be bound by these Terms of Use. If you do not agree, do not use Orally.

2. Description of Service

Orally is an AI-powered oral health application that analyzes images of your tongue, gums, and teeth to provide health scores and personalized improvement plans. The service includes:

• Tongue, gum, teeth, and whitening scans using device cameras
• Fresh Breath Scores and factor breakdowns
• Personalized 7-day improvement plans
• Product ingredient scanner for microbiome safety
• Progress tracking and streak monitoring

3. Medical Disclaimer

Orally is not a medical device and does not provide medical diagnoses. The AI analysis and scores are for informational and educational purposes only. Always consult a qualified dental or healthcare professional for diagnosis and treatment of any oral health condition.

Do not delay seeking professional advice or disregard medical guidance based on information from Orally.

4. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

5. Acceptable Use

You agree not to:

• Use Orally for any unlawful purpose or in violation of any regulations.
• Attempt to reverse-engineer, decompile, or extract source code from the app.
• Upload images that do not belong to you or that contain illegal content.
• Use the service in a way that could harm, disable, or impair Orally's servers or other users' experience.
• Misrepresent scan results or use them to mislead others about their oral health status.

6. Intellectual Property

All content, features, and functionality of Orally — including but not limited to text, graphics, AI models, software, and code — are owned by Orally and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

7. User Content

By submitting scan images through the app, you grant Orally a limited license to process those images for the purpose of providing the service (AI analysis). You retain ownership of your images. Refer to our Privacy Policy for details on how images are handled.

8. Limitation of Liability

To the fullest extent permitted by law, Orally shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. The total liability of Orally for any claim arising from these terms shall not exceed the amount you paid for the service in the past 12 months.

9. Disclaimer of Warranties

Orally is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be error-free, uninterrupted, or that AI analysis results will be accurate, complete, or suitable for any particular purpose.

10. Termination

We reserve the right to suspend or terminate your account at any time for violations of these terms. You may delete your account at any time from within the app. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use of Orally after changes take effect constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Orally operates, without regard to conflict of law principles.
